Welcome to Aurum Metal LLC (“Aurum” or “Company”). Aurum accepts orders for the purchase of Precious Metals, subject to these Terms & Conditions. Please read these Terms & Conditions carefully as they are binding between You, the “Customer”, and Aurum. The Customer and Company may be collectively referred to throughout this agreement as “Parties” or individually as “Party”.
1. Acceptance of Terms and Scope of Agreement
Aurum offers many products for sale including gold, silver, platinum, palladium, rhodium, iridium, ruthenium, and other Platinum-group metals (“Precious Metals”). By accessing Aurum's website, creating an account, placing an order, or engaging in any transaction or business with Aurum, you agree to be bound by these Terms & Conditions, the Privacy Policy, and all applicable laws and regulations. The Privacy Policy is incorporated into these Terms & Conditions by reference.
These Terms & Conditions apply to each order or transaction with Aurum. Aurum may revise these Terms & Conditions at any time. When you enter into any transaction with Aurum, you are deemed to have accepted the version of these Terms & Conditions then in effect. Aurum will post the current version of these Terms & Conditions on its website and will also provide the same to you upon request.
You must be eighteen (18) years or older to purchase any products through Aurum. By proceeding with any transaction with Aurum, you acknowledge that you are eighteen (18) years or older.
2. Product Availability
All Precious Metals displayed on the website are subject to their availability. Precious Metal inventory may fluctuate rapidly due to market conditions and supplier availability. If your product becomes unavailable after the order is confirmed, Aurum reserves the right, at its sole discretion, to either (i) substitute the unavailable product with a commercially reasonable substitute product of equivalent metal type, purity, and weight; or (ii) cancel the transaction and refund the Customer. Notwithstanding product availability, orders may be delayed pending payment clearance, fraud review, identity verification, AML/KYC review, or additional documentation requests.
3. Pricing and Market Volatility
The Precious Metals Aurum offers for sale on the website are commodities traded on global markets. Consequently, the market price of such Precious Metals fluctuates constantly based on supply, demand, and global market conditions. All prices displayed on the website are derived from live Precious Metals market pricing and data. However, due to rapid market movements, transmission delays, or technical latency, prices may change without notice at any time prior to final order confirmation.
Customer explicitly acknowledges and agrees that Aurum possesses sole discretion to establish the sale and purchase prices of all Precious Metals offered on our website. By submitting an order, Customer accepts these Terms & Conditions. Prices are locked only after Aurum issues an order confirmation and remain subject to successful payment verification and compliance review.
Aurum reserves the right, in its sole discretion, to refuse, limit, cancel, rescind or reject any order at any time for legitimate business, legal, compliance, or operational reasons. This includes, but is not limited to, pricing errors, typographical mistakes, software or technical errors, suspected fraud or suspicious activity, regulatory compliance concerns, failed payment verification, inventory shortages, or periods of extreme or abnormal market volatility.
4. Payment Terms
Customer shall submit payment in full for the Precious Metals at the time of purchase. Such payment must include the full amount owing to Aurum, including but not limited to, payment for the Precious Metals product, shipping and handling charges, and any transaction and/or other fees, as may be applicable. Customer shall make all payments unconditionally and without any setoff, recoupment, or counterclaim.
Payments may be made by way of direct bank wire, ACH transfer, credit or debit card, cryptocurrency, or other methods approved in writing by Aurum. All credit and debit card transactions are subject to a non-refundable four and one-half percent (4.5%) processing fee, which shall be explicitly disclosed to the Customer at the point-of-sale checkout prior to purchase.
For orders paid via cryptocurrency, the exchange rate is locked for a maximum of fifteen (15) minutes from order generation. If the transaction is not confirmed on the blockchain within this window, Aurum reserves the right to recalculate the purchase price based on the prevailing live market rate at the time of sufficient block confirmation, or cancel the order entirely.
Unauthorized chargebacks, payment reversals, or fraudulent disputes may result in account suspension, collections activity, legal action, and recovery of damages, costs, and attorneys' fees. Prior to initiating any credit card chargeback, payment reversal, or formal legal claim, the Customer agrees to submit the dispute in writing to Aurum via email at support@aurummetal.net.
5. Shipping Policy
Orders may be shipped via USPS, UPS, FedEx, armored carrier services, or other approved carriers selected by Aurum in its sole discretion. Orders shall generally ship within one (1) to three (3) business days after payment has cleared and Customer has successfully completed any compliance or verification reviews. Delivery estimates are not guarantees.
Aurum ships only to verified physical street addresses within the contiguous United States, Alaska, and Hawaii. Aurum does not ship to P.O. boxes, private mailboxes, freight forwarders, reshipping facilities, or third-party logistics addresses. International shipments are not available at this time.
All shipments are securely and discreetly packaged. External packaging does not identify the contents as Precious Metals or disclose the package value. Tracking numbers are provided for all shipments. Orders are fully insured while in transit.
Customers must notify Aurum within twenty-four (24) hours of delivery confirmation regarding lost packages, damaged shipments, tampering, shortages, or delivery discrepancies. Failure to provide timely notice may impact insurance claim eligibility.
6. Return Policy and Market-Loss Protection
ALL SALES ARE FINAL. Except as expressly set forth herein or as otherwise required by applicable law, all sales are final. Due to the highly volatile nature of Precious Metals markets, Aurum does not permit cancellations, refunds, exchanges, reversals, or returns once an order has been confirmed. Transactions are locked and binding immediately upon order confirmation.
By placing an order with Aurum, you acknowledge and agree to the following terms:
- Precious Metals prices are volatile and continuously fluctuate in real-time. Customer assumes all price risk from the exact moment of order confirmation.
- Aurum is under no obligation to repurchase any products from the Customer at any time.
- If an order is refused, defaulted, disputed via chargeback, or otherwise canceled after confirmation due to Customer's actions or breach, the Customer shall be responsible for any commercially reasonable market losses incurred by Aurum as a direct result.
- Market loss is calculated as the difference between the locked purchase price at order confirmation and the lower prevailing market price at the time of cancellation or default, as determined solely by Aurum.
- In the event of a breach, cancellation, or payment dispute, the Customer shall reimburse Aurum for all associated payment processing fees, collection costs, return shipping and insurance costs, reasonable attorneys' fees, and any other related statutory damages.
7. AML/KYC Compliance
Aurum is fully committed to complying with all applicable anti-money laundering (“AML”) and counter-terrorist financing (“CTF”) laws and regulations, including those set forth by the Financial Crimes Enforcement Network (“FinCEN”). Aurum enforces a strict “Know Your Customer” (“KYC”) policy to prevent financial crimes, money laundering, and illicit activities.
Aurum actively monitors transactions for signs of suspicious, fraudulent, or unusual activity. Aurum reserves the right to refuse service, reject any order, or terminate any user account at its sole discretion, particularly if a customer fails to provide the requested KYC documentation or if the transaction is flagged as high-risk or suspicious.
8. Intellectual Property
All contents, features, and functionality on Aurum's website, including, but not limited to, text, graphics, logos, images, audio clips, data, charts, pricing methodologies, software, and the compilation thereof (collectively “Intellectual Property”) are the exclusive property of Aurum and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9. Indemnification
You agree to defend, indemnify and hold harmless Aurum, and its parents, subsidiaries, affiliates, officers, directors, agents, employees, licensors, members, and shareholders, from any and all claims, expenses, liabilities, losses, actions, damages, or demands, including without limitation reasonable attorneys' fees, made by any third party or by Aurum directly, arising out of or related to, whether directly or indirectly: (a) content or information you transmit or obtain through the transactions, products and/or services contemplated in these Terms & Conditions, (b) your use, purchase, and/or sale of the products and/or services contemplated in these Terms & Conditions, (c) your violation of these Terms & Conditions, (d) your violation of any rights of another, (e) your breach of any representation or warranty made by you to Aurum, or (f) your failure to perform your obligations pursuant to these Terms & Conditions.
10. Governing Law and Arbitration
Through your use of the website, you agree that the laws of New Jersey shall govern any matter or dispute relating to or arising out of these Terms & Conditions, as well as any dispute of any kind that may arise between you and the Company, with the exception of its conflict of law provisions.
In case of a dispute between the Parties relating to or arising out of these Terms & Conditions, the Parties shall submit the dispute to binding arbitration. Arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its applicable Consumer Arbitration Rules. The arbitration shall take place in Middlesex County, New Jersey, unless otherwise agreed by the Parties in writing.
THE PARTIES WAIVE ANY RIGHTS THEY MAY HAVE TO A JURY TRIAL IN REGARD TO ANY CLAIMS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE PARTIES FURTHER AGREE THAT ANY CLAIMS SHALL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
11. Modification & Variation
Aurum may modify these Terms & Conditions from time to time by posting updated versions on the website. Unless otherwise stated, revisions become effective upon posting and apply prospectively to future access, use, accounts, and transactions.
12. Severability
If any provision contained in these Terms & Conditions, or any future modification, either in whole or in part, is deemed or held to be invalid or unenforceable by any court of competent jurisdiction, the remainder of any partially declared invalid or unenforceable provision and all other provisions of these Terms & Conditions shall, nonetheless, remain and continue in full force and effect.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT IN CASES OF GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR LIABILITY THAT CANNOT LEGALLY BE EXCLUDED, YOU AGREE THAT THE COMPANY AND ITS EMPLOYEES, OFFICERS, DIRECTORS, OR SHAREHOLDERS SHALL NOT BE LIABLE TO YOU FOR ANY (A) INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, EXEMPLARY OR STATUTORY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL OR FOR ANY COST OF COVER OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES), EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT, WHETHER IN BREACH OF CONTRACT OR IN TORT, INCLUDING NEGLIGENCE, OR (B) MARKET LOSSES, DELAYED SHIPMENTS, CARRIER ISSUES, SYSTEM INTERRUPTIONS, PRICING ERRORS, OR THIRD-PARTY FAILURES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF THE COMPANY SHALL IN NO CASE EXCEED THE PURCHASE PRICE OF THE PRECIOUS METALS FOR WHICH ANY CLAIM IS MADE.
14. No Warranty
Unless otherwise set forth in these Terms & Conditions, all Precious Metals sold by Aurum under these Terms & Conditions are provided AS IS, WHERE IS. Aurum makes no warranty as to the intended use or application of the Precious Metals by Customer. AURUM HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, AND WHETHER ARISING BY OPERATION OF LAW, COURSE OF DEALING, OR USAGE OF TRADE, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
15. Confidentiality
Each Party will respect the confidentiality of information acquired from the other Party under these Terms & Conditions. Neither Party will, without the consent of the other, disclose to any other person any information acquired under these Terms & Conditions.
16. Taxes
Customer is responsible for and shall pay any tax, duty, fee or other levy or charge imposed with respect to the purchase, sale, or delivery of any Precious Metals under these Terms & Conditions. Customer shall indemnify Aurum against any payments made by Aurum on account of said tax, duty, fee, charge, or levy, whether correctly or incorrectly asserted.
17. Compliance with Laws
In fulfilling these Terms & Conditions, each Party will comply with all applicable international, federal, state and local laws, rules, regulations, ordinances and protocols.
18. Account Security
Customer is responsible for maintaining the confidentiality of account credentials and for all activity occurring under the Customer's account. Customer agrees to immediately notify Aurum of any unauthorized use of the account or security breach.
19. Entire Agreement
These Terms & Conditions, together with any documents expressly incorporated herein by reference, including Aurum's Privacy Policy, constitute the entire agreement between the Customer and Aurum with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding such subject matter.
20. Headings for Convenience Only
Headings of parts and sub-parts under these Terms & Conditions are for convenience and organization only. Headings shall not affect the meaning of any provisions of these Terms & Conditions.
21. Force Majeure
The Company is not liable for any failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, pandemics, cyberattacks, internet outages, infrastructure failures, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances.
22. Electronic Communications Permitted
Electronic communications are permitted to both Parties under these Terms & Conditions, including e-mail. For any questions or concerns, please email us at support@aurummetal.net.
23. Waiver
The failure of either Party to insist upon strict performance of the provisions of these Terms & Conditions shall not be construed as a waiver of any subsequent default of the same or similar nature. Failure to enforce any right or provision under these Terms & Conditions does not constitute a waiver of future enforcement of that right or provision.
24. Notice
Notices under these Terms & Conditions must be in writing and delivered by email or recognized overnight courier. All notices to Aurum shall be sent to: Aurum Metal LLC, 15 W. 47th Street, Suite 711, New York, NY 10036. For notices delivered by email, the address is: support@aurummetal.net.
25. Further Assurances
The Parties shall with reasonable diligence do all such things and provide all such reasonable assurances as may be required to consummate the transactions contemplated under these Terms & Conditions.
26. No Agency
Nothing in these Terms & Conditions shall constitute or be deemed to constitute one party as agent of the other, for any purpose whatsoever, and neither party shall have the authority or power to bind the other, or to contract in the name of or create a liability against the other, in any way or for any purpose.
27. Electronic Signatures
Customer agrees that electronic communications, electronic records, electronic acceptance of these Terms & Conditions, and electronically executed transactions constitute legally binding agreements and signatures under the Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”) and applicable state law.
